Regulation 7 of the Management of Health & Safety Regulations 1999 (MHSWR) requires an employer to appoint one or more competent persons to assist in undertaking the measures necessary to comply with the numerous obligations under health, safety and fire law.
Competence is broadly defined in regulation 7(5) of the MHSWR as referring to someone with “sufficient training and experience or knowledge and other qualities to enable him to assist…”. Competence is, therefore, an intricate blend of knowledge, training, experience and qualifications, plus an awareness of ones’ own limitations.
More complicated situations will require the competent person to have a higher level of knowledge and experience calling for more specific applied knowledge and skills which can be offered by appropriately qualified specialists.
Employers should be aware that, depending on the nature of the business and the risks involved, employers will need to check the appropriate health and safety qualifications etc of those they appoint, to satisfy themselves that they have a sufficiently high level of competence
